It would be consistent with what occurred during his Australian trial; he wasn't convicted of murder, essentially his conviction was for being a bad dive buddy who left his partner to die at depth.
I'm curious if the evidence from the dive computer was preserved and will be presented at trial here, and what conclusions will be drawn in the US that Oz authorities found inconclusive if it is.

I am sure there are lots of people who would want to take him diving if he gets off.

I'd really love to sit in on this trial since it is in Birmingham. I'm particularly interested in how the information will be presented to the jury, and how well they will understand all the intricacies of diving. According to the local news they hope to have jury selection completed tomorrow.
