So Michelle (and other esquires on the board) ... how do you feel about "loser pays" tort reform?

I'm not familiar with this tort reform you are referring to. If you mean that the loser pays the other party's costs, we have had something like that here for ages. Most of the time costs are assessed on a tariff basis (unless there has been some particularly agregious conduct on the part of a party) that, not surprisingly, does not fully compensate a party for their legal fees but can still be fairly substantial. Disbursement costs are also recoverable although our courts have capped how much someone can claim for certain items (for instance, per page costs of photocopying).

The chance of being burdened with costs to the other party at least makes parties think before bringing frivilous lawsuits with no chance of success.

Oh, I wasn't sure, thought it had something to do with your tag line, which I am not sure I understand.

Does it mean you want whoever has "drugs" in their mouth at the bus station to keep telling you how to dive, so you will keep them from taking the drugs at 2 a.m.? Or do they work at the bus station at 2 a.m. ... if so, they might need to keep taking those "drugs" to keep them awake. So, maybe you Don't want them to tell you how to dive, and then you won't take away their "drugs" (so they can stay awake!) Sounds kind of complicated, that's what those "drugs" will do to you!

Not to take this too far off topic, but I have the opposite viewpoint of Boatlawyer's. My company currently has about a dozen lawsuits against us in various levels of progress, and I can say with 100% conviction that all of them are total b.s. - the plaintiffs are looking at the legal system as a lottery. They are hoping that they can drag it out as long as necessary that we will just settle to make them go away. Unfortunately, we have too often done exactly that. The problem is that I have been so far unable to convince our Board that we need to be as aggressive as we can and to very publicly take at least one of these all the way to trial and to countersue for whatever we can to make a very public example of one of these extortionists so that others might think twice about trying to strongarm us. This is nothing more than extortion, and I can guarantee that every one of you on this board who has bought a car in the last ten years has personally paid for lawsuits against my company. That is wrong. Companies have taken to this shakedown as a cost of doing business, kind of like paying off the mob for "protection."

There is a great deal of that taking place. I agree there needs to be something done to control it. OTOH, that fact shouldn't prevent legitimate suits from going forward.
